MORIS informs about the amendments to the resolution regulating the procedure for reserving military conscripts
Among the main changes affecting businesses:
- The period for reserving military conscripts has been increased from 6 to 12 months;
- The number of military conscripts to be reserved must constitute 50 percent of the number of military conscripts of the enterprise as of May 18, 2024, and for enterprises established after May 18, 2024, as of the date of submission of the lists;
- Military conscripts who have a documented postponement of mobilization are not subject to reservation;
- Military conscript employees (including The Director (CEO) of the company and their deputies), ultimate beneficial owners of enterprises, and members of supervisory boards (in certain cases) may be subject to reservation regardless of military rank, age, and military registration specialty (MRS);
- Reserving military conscripts can be done, including through the Diia portal;
- Added Clause: If there are doubts about the information provided by the enterprise for reserving military conscripts, the authority recognizing the enterprise as critically important may require documentary confirmation of this information;
- Territorial Centres of Recruitment and Social Support, in which the conscripted employee is on military registration, on the basis of the reservation decision, within a period of no more than 5 working days, enters information about the conscript's reservation into the "Oberig" register;
- Added new grounds for canceling a reservation, namely - (1) temporary suspension of the employment contract of a military conscript with an enterprise, (2) a substantiated submission by the head of a state authority, another state authority, a local self-government authority, an enterprise, an institution and an organization and ( 3) granting a postponement for other reasons specified by the Law of Ukraine".
