The President Signed the Law on the Resumption of the Statute of Limitations
On June 3, 2025, the newspaper Holos Ukrainy published the Law of Ukraine “On Amending the Section ‘Final and Transitional Provisions’ of the Civil Code of Ukraine Regarding the Resumption of the Statute of Limitations,” dated May 14, 2025, No. 4434-IX.
What does this mean?
From now on, in accordance with the relevant amendments, the suspension of the statute of limitations, which had been in effect since March 2020 — initially due to quarantine, and later due to martial law — is cancelled.
Thus, the statute of limitations will resume.
When does the law come into force?
The law will enter into force three months after the date of official publication. This means that the statute of limitations will resume from September 3, 2025.
Why is this important for business?
According to Part 4 of Article 267 of the Civil Code of Ukraine, if the statute of limitations has expired (and the opposing party raises this as a defense), this is grounds for dismissal of a claim.
Therefore, now more than ever, it is important to:
conduct an audit of legal relationships with counterparties;
verify whether any deadlines for filing claims are approaching;
proactively prepare all necessary steps to protect your rights;
if necessary, file legal claims in court before September 4, 2025.
