The Court of Appeal has upheld the appeal filed by MORIS lawyers on behalf of Bohdan "Tavr" Krotevych

The case concerns potential negligence by senior officials of the Armed Forces of Ukraine in relation to Ukraine’s military formations during the defense of Mariupol.

Tetiana Honchairuk, Partner at MORIS, attorney-at-law commented: “Ukraine is in a state of war, and every citizen must contribute to Victory by protecting both the state and those who defend it. Amid the armed aggression by the russian federation, it is particularly important to ensure the effective functioning of the Armed Forces and to hold accountable those responsible for negligence.

As a criminal defense attorney with an officer's rank and an understanding of military affairs, I could not stand by in the face of possible negligence in military service by senior officials who failed to properly organize the defense of Ukraine’s borders. This negligence resulted in grave consequences in the form of human losses, territorial losses, and the loss of military equipment in eastern Ukraine, specifically, but not limited to, the Mariupol direction.

Bohdan Krotevych approached law enforcement agencies to hold the responsible parties liable for their actions. However, the inaction of the authorized representatives of the SBI, i.e. their failure to enter information about the criminal offense into the Unified Register of Pre-Trial Investigations (ERDR), necessitated the appeal of these actions to the court, first to the Shevchenkivskyi District Court of Kyiv, and then to the Kyiv Court of Appeal. As a result, the court of appeal was objective and rendered a lawful decision requiring the opening of criminal proceedings.

We now face a long way to achieving a final lawful decision in this case, which will not be easy, but it is certainly achievable. We believe and work towards ensuring that the rule of law and justice prevail, and that all of Ukraine triumphs!"
